Plain-English guide
Four terms that decide how to read this case.
- Complaint
- The plaintiffs' side of the story. Everything in it is an allegation until proven, including the screenshots they chose.
- Motion to dismiss
- The defendants ask the court to end claims without a trial. The judge assumes the allegations are true and asks only whether they state a legal claim.
- Surviving claims
- Pleaded well enough to continue to discovery, summary judgment or trial. Surviving is not winning.
- Liability
- A finding that a defendant is legally responsible. No court has made one in this case.
