Court record

Aguilar v. Baton Corporation

A civil case in New York. Allegations on one side, rulings on the other.

Court
U.S. District Court, Southern District of New York
Case
No. 1:25-cv-00880 (CM), Judge Colleen McMahon
Decision
Motions to dismiss,

Procedural status

Pending at the pleading stage. Only the RICO counts (I and II) survive, for two plaintiffs against Baton, Cohen, Kerler and Tweedale. No one has been found liable. Civil case: no charges.

Details

After the 31 August 2026 decision, Counts I and II (substantive RICO and RICO conspiracy) remain, but only as brought by Carnahan and Okafor against Baton, Cohen, Kerler and Tweedale. Every other count, and every claim against the Solana defendants, was dismissed. No one has been charged or convicted of anything in this case.

Later developments: none verified. The court ordered plaintiffs to show cause by 10 September 2026 about the unserved KOL Doe defendants. We could not see what followed: the CourtListener docket returned HTTP 403 to our check on 27 October 2026, and plaintiffs' counsel's page lists nothing after 2 September 2026.
