Summary
Judge McMahon denied the motions to dismiss the RICO counts brought by Carnahan and Okafor against Baton, Cohen, Kerler and Tweedale. She dismissed Aguilar's claims, all claims against the Solana defendants, the Securities Act counts and unjust enrichment. She held that the memecoin transactions alleged are not gambling under New York law.
“the purchase and sale of memecoins, chancy though it be, is not the placing of a bet”
What the sources support
The 79-page opinion, pages 3, 45–50 and 77–79, read in full on 27 October 2026.
- The disposition of each count, which is listed on the court-record page.
- That the gambling holding is limited to the transactions alleged (page 47, footnote 6).
What remains unresolved
- Whether the surviving allegations are true. A motion to dismiss assumes them true for argument's sake.
- Anything filed after 31 August 2026, including the response to the order to show cause due 10 September 2026. The docket could not be loaded.
Limits of this receipt
- This is not a finding that the defendants did anything unlawful. It is not a criminal case, and nobody has been convicted.
- It does not hold that all memecoin trading is or is not gambling everywhere.

Opinion and Order granting in part and denying in part the motions to dismiss:
At this stage a court assumes the complaint's factual allegations are true and asks only whether they state a legal claim. Some RICO claims passed that test and continue. Many other claims did not. The ruling does not decide what actually happened, and the court said that 12(b)(6) dismissals were with prejudice.
- Allowed to proceed Counts I–II: substantive RICO and RICO conspiracy (18 U.S.C. § 1962(c), (d)): Carnahan and Okafor v. Baton Corporation Ltd., Alon Cohen, Dylan Kerler, Noah Tweedale.
- Dismissed All claims by Diego Aguilar: Aguilar v. every moving defendant.
- Dismissed All claims against the Solana defendants: Solana Labs, Solana Foundation, Yakovenko, Gokal, Albert, Federa, Liu.
- Predicate rejected Gambling predicates (18 U.S.C. § 1955; N.Y. Penal Law §§ 225.05, 225.10): All moving defendants.
Sources
- This decides motions to dismiss. It asks whether allegations, assumed true, state a claim. It is not a finding that any allegation was proven.
- UNREPOST could not load the CourtListener docket (HTTP 403 on 27 October 2026), so filings after 31 August 2026 have not been checked.
- This copy comes from plaintiffs' counsel's website. It matches the case caption and docket references, but we did not compare it with the PACER original.
- This is an advocate's summary. Use it for case identifiers and update dates, not as a neutral account of the ruling.
- The page lists no development after 2 September 2026. That does not show nothing happened later.
